Model Acceptable Use Policy

This Model Acceptable Use Policy (the “Model AUP”) sets out the conditions under which you may access and use the model weights, parameters, and associated materials, and any modified version (the “Model Materials”) made available by Thinking Machines Lab (“Company”, “we”, “us”, or “our”). By accessing, downloading, or using any Model Materials, you agree to be bound by this Model AUP, unless we have otherwise agreed in writing.

If you access or use the Model Materials through our Tinker platform, your use is also governed by our Service Terms of Use. In the event of a conflict between this Model AUP and the Service Terms of Use with respect to use of the Model Materials, this Model AUP controls.

Permitted Use

You may use the Model Materials for lawful purposes in accordance with this Model AUP and all applicable laws and regulations. You are responsible for ensuring that your use of the Model Materials — and any products or services you build using them — complies with this Model AUP. If you permit others to use the Model Materials through your products or services, you are responsible for their compliance as well.

Restrictions

You shall not do, and shall not assist, permit, or enable any third party to do, anything illegal nor any of the following (whether or not it’s illegal).

Illegal Activity

• Do not use the Model Materials to engage in, facilitate, or promote any illegal or unlawful activity, including violence, terrorism, or any other criminal conduct. In particular, do not use the Model Materials as part of an AI system that deploys subliminal, manipulative, or deceptive techniques to impair a person’s ability to make informed decisions; that exploits vulnerabilities of a person or group due to age, disability or situation; for evaluation or classification of persons or groups which leads to detrimental or unfavourable treatment that is unjustified, disproportionate or in unrelated contexts; for assessing a person’s risk of criminality based on profiling or their personality traits or characteristics; that contributes to a facial recognition database through untargeted scraping of images from the internet or CCTV footage; that infers emotions of a person in the workplace or education based on biometric data other than for medical or safety reasons; that categorizes a person based on biometric data to infer sensitive characteristics; or for unlawful real-time remote biometric identification in public spaces.
• Do not use the Model Materials in violation of any applicable trade compliance, export control, or sanctions laws or regulations.

Child Safety

• Do not use the Model Materials to generate, manipulate, distribute, promote, or facilitate any content that exploits, harms, or sexually depicts minors, including child sexual abuse material (CSAM), or any content that sexualizes individuals under the age of 18 in any context.
• Do not use the Model Materials to promote or facilitate the grooming, exploitation, trafficking, or abuse of minors, or to distribute materials to minors illegally.

Violence and Bodily Harm

• Do not use the Model Materials to facilitate the creation of biological, chemical, nuclear, or radiological weapons with mass-casualty potential.
• Do not use the Model Materials to facilitate attacks on critical infrastructure — including power grids, water systems, or financial systems — or to create cyberweapons or malicious code.
• Do not use the Model Materials to facilitate the acquisition, manufacture, or illegal use of firearms, ammunition, or other weapons, including by circumventing legally required background checks, licensing requirements, or other applicable controls.
• Do not use the Model Materials to generate content that provides operational guidance for violence against individuals or groups, or that incites, recruits for, or celebrates violent extremism.
• Do not use the Model Materials to generate content that instructs, encourages, normalizes, or glorifies self-harm or suicide.
• Do not use the Model Materials to engage in, promote, incite, facilitate, or assist in the planning or development of activities that present a risk of death or bodily harm to individuals.

Hate, Harassment, and Discrimination

• Do not use the Model Materials to generate content that dehumanizes, degrades, or promotes hatred or discrimination toward individuals or groups.
• Do not use the Model Materials to make automated (non-human) decisions that affect an individual’s rights (including financial, legal, employment, healthcare, housing, insurance, or social services decisions).
• Do not use the Model Materials to harass, threaten, abuse, or bully individuals or groups.

Sexual Content

• Do not use the Model Materials to generate content depicting non-consensual, coerced, or revenge-motivated sexual acts, regardless of whether the content is framed as fictional or otherwise.
• Do not use the Model Materials to generate or manipulate sexually explicit content for purposes other than scientific, educational, documentary, or artistic purposes.
• Do not use the model to generate or manipulate realistic depictions of intimate parts of real, identifiable individuals without their freely-given, specific, informed, unambiguous and explicit consent, or to facilitate sexual solicitation or illegal commercial sexual services.

Privacy

• Do not use the Model Materials to collect, process, generate, infer, or disclose private or sensitive information about individuals without authorization.
• Do not use the Model Materials to facilitate online or real-world surveillance, tracking, or profiling of individuals without authorization.
• Do not use the Model Materials to deanonymize or ‘dox’ individuals.
• Do not use the Model Materials to defeat or circumvent privacy-enhancing technologies in order to expose, re-identify, track, or surveil the people they protect.

Third-Party Rights

• Do not use the Model Materials to infringe, misappropriate, or otherwise violate any third-party rights, including intellectual property rights.

Spam, Deception, and Misinformation

• Do not use the Model Materials to generate content designed to deceive or defraud others, including scams, phishing, or fraudulent solicitations.
• Do not use the Model Materials to impersonate real individuals or generate content designed to be mistaken for their genuine statements or actions.
• Do not use the Model Materials to generate or spread spam or demonstrably false information likely to cause public harm, including false claims about public health, electoral processes, or scientific consensus.
• Do not use the Model Materials to generate content falsely representing AI-generated outputs as human-generated, or to deploy the Model Materials in a manner that systematically deceives users into believing they are interacting with a human.

Human Trafficking and Exploitation

• Do not use the Model Materials to facilitate human trafficking, forced labor, sexual violence, or sexual exploitation, including by generating recruitment scripts or coercive content designed to enable the control or exploitation of individuals.

Illegal Drugs and Controlled Substances

• Do not use the Model Materials to facilitate or assist in activities presenting risk of harm relating to illegal drugs and controlled substances, including to provide synthesis routes, manufacturing instructions, or distribution guidance for controlled substances, or to facilitate the procurement of prescription medications without a valid prescription.

Professional Services

• Do not use the Model Materials to engage in unauthorized or unlicensed professional practice or advising — including medical, legal, or financial advice — or to automate consequential decisions in these domains without appropriate human oversight.

Circumvention and Interference

• Do not attempt to circumvent, disable, or remove measures implemented in the Model Materials or in any system built using them, or use the Model Materials or develop services, to engage in conduct or generate or manipulate content prohibited by this Model AUP.
• Do not use the Model Materials to generate or facilitate creation of malicious materials or anything that could overburden or interfere with or impair the intended integrity or operation of a website or computer system.

Disclosure

If you deploy the Model Materials in a product or service made available to end users, you agree to disclose to those users any known material limitations or risks of the AI system, and that they are interacting with an AI system wherever required by law or where that fact would be material to their understanding of the interaction.

Updates

We may update this Model AUP at any time, in which case we will update the “Last Updated” date above. Your continued use of the Model Materials after any update constitutes acceptance of the revised Model AUP. If we make material changes, we will use reasonable efforts to notify you, such as by posting a notice or sending an email.
